Mobile Texting Service Terms and Conditions Agreement

This Mobile Texting Service Terms and Conditions Agreement (“Agreement”) governs your use of text messaging services offered by Interventional SpineCare, a professional corporation with its principal office located at 100 Motor Parkway, Suite LL-8, Hauppauge, NY 11788 (referred to as “Company,” “we,” “us,” or “our”). By using our SMS Service, you agree to these terms and conditions, our Privacy Policy, and all applicable laws and regulations.

Acceptance of Terms

By opting into or using our text messaging Service, you agree to comply with this Agreement. If you do not agree, please do not use the Service.

Eligibility

To use our SMS Service, you must be at least 18 years old or the age of majority in your jurisdiction. If acting on behalf of an organization, you represent that you have authority to bind that organization.

Service Description

The Service allows you to receive SMS messages related to appointments, health updates, educational materials, promotional content, and administrative notices. Message frequency may vary. We reserve the right to alter message frequency or discontinue the Service at any time. Our messaging service allows you to reply with commands such as STOP (to unsubscribe) and HELP (for additional assistance), in addition to any normal replies permitted by your provider.

Consent and Opt-In Methods

Consent is obtained via one or more of the following methods:

  • Submission of your phone number through a form on our website
  • Verbal consent provided during a phone call or in-person encounter
  • Written consent via a paper intake form or HIPAA-compliant document
  • Text-based confirmation from your mobile device in response to opt-in prompts

Each opt-in method discloses message purpose, frequency, and opt-out instructions. Screenshots and documentation of opt-in methods are available upon request and stored securely for A2P 10DLC compliance.

Opt-Out Instructions

You may cancel SMS messages at any time by replying STOP. After you send STOP, we will confirm your opt-out. To get help, reply HELP for additional instructions. To re-subscribe, you may opt in again through our website or by texting START to the original number.

Service Availability

While we aim to offer uninterrupted service, we cannot guarantee continuous access due to carrier disruptions, maintenance, or technical issues.

Privacy Policy

Your use of the SMS Service is subject to our Privacy Policy. Your information is handled in accordance with HIPAA, TCPA, and other applicable federal and state laws.

Third-Party Disclosures

We do not sell or lease your SMS-related data to third parties. Messaging platforms (e.g., Twilio) may access limited metadata to support delivery.

A2P 10DLC and Twilio Messaging Compliance

All campaigns are registered through Twilio’s A2P 10DLC platform and comply with carrier and federal guidelines. Our messages include required elements like brand name, message purpose, and opt-out language. Read more on the Twilio Messaging Policy.

Prohibited Uses

Use of the Service for spamming, fraud, or prohibited content (e.g., SHAFT topics: Sex, Hate, Alcohol, Firearms, Tobacco) is strictly forbidden. Violators may be suspended or banned.

Security

We maintain administrative, technical, and physical safeguards to protect SMS data. However, no method of transmission is completely secure.

Disclaimers

The Service is provided “as is” without warranties of any kind. We make no guarantee of timeliness, accuracy, or completeness of message content.

Limitation of Liability

To the extent permitted by law, we shall not be liable for any damages (direct or indirect) arising out of the use or inability to use the SMS Service, including but not limited to delays, undelivered messages, or third-party misuse.

Governing Law

This Agreement shall be governed by the laws of the State of New York. Any disputes arising from this Agreement shall be resolved in a court of competent jurisdiction within Suffolk County, NY.

Modifications to Agreement

We may modify these terms from time to time. Changes become effective upon posting to our website. Continued use of the Service constitutes your acceptance of the revised terms.
